Fulton County Commissioner Mo Ivory, Esq., has issued a detailed account of the recent FBI raid on the county’s elections office, underscoring significant legal and procedural concerns surrounding the seizure of hundreds of boxes of sensitive election materials.
In an Instagram video and accompanying post, Ivory confirmed that approximately 650–700 boxes were taken, including ballots, results tapes, recap sheets, and absentee ballot envelopes containing voters’ personal information.
While some records exist digitally, Ivory emphasized that not all physical documents were backed up, making their handling critical to maintaining legal integrity.
Disruption of Court-Approved Review
Ivory stressed that a court-approved review process was already scheduled, which included judicial oversight to ensure the chain of custody and safeguard against tampering or misrepresentation of election evidence. By executing the seizure prior to this judicial review, the FBI has, according to Ivory, effectively circumvented the legal process designed to protect both the integrity of the records and public trust.
“Once documents leave secure monitoring, officials cannot guarantee their integrity—even if they are returned,” she explained.
Compliance With Legal Authority
The commissioner clarified that county officials complied with the FBI warrant, noting that refusal could have exposed staff to potential obstruction of justice charges. Ivory rejected the notion that the county was attempting to withhold information, framing the issue as procedural rather than secretive.
“This isn’t about secrecy,” Ivory said. “It’s about following the proper legal procedures so facts remain facts.”
Concerns Over Transparency and Voter Privacy
Ivory raised concerns that the seizure did not enhance transparency, instead preempting the legal safeguards already in place to protect sensitive voter information and election evidence. She highlighted that some seized materials, particularly absentee ballot envelopes, contained personally identifiable voter data, underscoring the need for careful legal handling.
Legal Action and Next Steps
Fulton County is now exploring all available legal remedies in response to the raid, though Ivory declined to provide specifics pending formal court filings.
